Employer Defamation Against A Former Employee

Legal Topics> Jobs and Employment> Discrimination and Harassment> Libel and Slander

Employers who offer references to current and former employees may be exposed to liability for a wide range of things.

One example is when an employer injures a former employee’s reputation by making false statements about that employee.

The employee may then sue the employer for defamation.

What Must A Former Employee Prove To Establish A Case Of Defamation Against A Former Employer?

There are five elements that must be proven by the employee to succeed. They are:

The employer made a defamatory statement:

A statement is generally considered defamatory if it harms the former employee’s reputation by lowering him in the estimation of the community or deters third parties from associating or dealing with him.

The employer published the defamatory statement to a third party: Publication may be verbal or non-verbal.

The employer’s statement was false: Generally, the duty to prove that a defamatory statement is false falls on the former employee.

He must show specific facts demonstrating that his former employer’s statements were not well-grounded.

The employer was at fault in making the false statement: The fault an employee must prove is based on the extent of the employer’s knowledge that his statement was false.

The false statement caused injury to the employee’s reputation:

An employee must prove that his injuries would not have occurred if not for his employer’s false defamatory statements.

What Are Some Examples Of Defamation By An Employer?

Although you will want to consult with an attorney to determine whether your exact situation is sufficient to support a cause of action for defamation,

a few examples of possible situations that are likely to result in a successful claim are:

An employer falsely portraying a former employee as an individual who discriminated against a certain class of people

(i.e. African Americans)

An employer falsely alleging that an employee made threatening statements, firing him, and then telling future employers that employee had a history of making such statements

An employer telling a third party that his former employee had done a bad job when there was substantial evidence to the contrary

An employer telling a third party that a former employee’s constant alcohol abuse makes him not dependable as an employee

My Former Employer Made False Defamatory Statements About Me That Has Cost Me A New Potential Job –

Do I Need An Attorney?

Your best option is to contact an employment law attorney.

Your attorney can advise you of your rights and let you know if you may be entitled to collect compensation in a lawsuit against your former employer.

Sacrament of Penance: Examination of Conscience
Father John Trigilio

In the Sacrament of Penance the Faithful who confess their sins to a Priest, are sorry for those sins and have a purpose of amendment, receive from God, through the absolution given by that Priest, forgiveness of sins they have committed after Baptism, and at the same time they are reconciled with the Church, which by sinning they wounded.  (Canon 959)
Act of Contrition:    O my God, I am heartily sorry for having offended Thee, and I detest all my sins because I dread the loss of Heaven and fear the pains of hell, but most of all, because they offend Thee, my God, who art all good and worthy of all my love.  I firmly intend with the help of Thy grace to confess my sins, to do penance and to amend my life.  AMEN
               Examination of Conscience

Have I sinned against Religion by seriously believing in New Age, Scientology, Astrology, Horoscopes, Fortune-telling, Superstition or engaging in the Occult?  Did I endanger my Catholic Faith or cause scandal by associating with anti-Catholic groups & associations (e.g., the Freemasons)?  Have fame, fortune, money, career, pleasure, etc. replaced God as my highest priority?  Have I neglected my daily prayers?
II.  “Thou shalt not take the name of the Lord thy God in vain.”
Have I committed blasphemy by using the name of God and Jesus Christ to swear rather than to praise?  Have I committed sacrilege by showing disrespect to holy objects (crucifix, rosary) or contempt for religious persons (bishop, priests, deacons, women religious) or for sacred places (in Church).  Have I committed sacrilege by going to Holy Communion in the state of mortal sin without first going to confession e.g., after missing Mass on Sunday or a Holyday?  Did I violate the one-hour fast before Communion?  Did I break the laws of fast and abstinence during Lent?  Did I neglect my Easter duty to receive Holy Communion at least once?  Have I neglected to support the Church and the poor by sharing my time, talent and treasure?

Did I miss Mass on any Sunday or Holyday of Obligation?  (Bad weather and being sick do not count) Have I shown disrespect by leaving Mass early, not paying attention or not joining in the prayers?  Did I do unnecessary work on Sunday which could have been done the day before?  Have I been stingy in my support for the Church?  Do I give of my time & talent?

IV.  Honor thy Father and Mother.

Parents: Have I set a bad example for my children by casually missing Mass, neglecting prayer, or ignore my responsibility to provide a Catholic education by either sending my children to parochial school or to C.C.D. (Religious Education Program)?  Do I show little or no interest in my children’s faith and practice of it?  Have I showed disrespect for those in authority, government or church?  Have I not expressed my moral values to them?
Children: Have I been disobedient and/or disrespectful to my parents or guardians?  Did I neglect to help them with household chores?  Have I caused them unnecessary worry and anxiety by my attitude, behavior, moods, etc.?
V.  Thou shalt not kill.
Did I consent, recommend, advise, approve, support or have an abortion?  Did I realize that there is an excommunication for anyone who procures an abortion?  Did I actively or passively cooperate with an act of euthanasia whereby ordinary means were stopped or means taken to directly end the life of an elderly or sick person?  Have I committed an act of violence or abuse (physical, sexual, emotional or verbal)?  Have I endangered the lives of others by reckless driving or by driving under the influence of drugs or alcohol?  Do I show contempt for my body by neglecting to take care of my own health?  Have I been mean or unjust to anyone?  Have I held a grudge or sought revenge against someone who wronged me?  Do I point out others’ faults and mistakes while ignoring my own?  Do I complain more than I compliment?  Am I ungrateful for what other people do for me?  Do I tear people down rather than encourage them?  Am I prejudiced against people because of their color, language or ethnic-religious background?
VI.  Thou shalt not commit adultery.
IX.  Thou shalt not covet thy neighbor’s wife.
Did I have any sex before or outside of marriage?  Do I view pornographic material (magazines, videos, internet, hot-lines)?  Have I gone to massage parlors or adult book stores?  Did I commit the sins of masturbation and/or artificial contraception?  Have I not avoided the occasions of sin (persons or places) which would tempt me to be unfaithful to my spouse or to my own chastity?  Do I encourage and entertain impure thoughts and desires?  Do I tell or listen to dirty jokes?  Have I committed fornication or adultery?
VII.  Thou shalt not steal.
X.  Thou shalt not covet thy neighbor’s goods.
Have I stolen any object, committed any shoplifting or cheated anyone of their money?  Did I knowingly deceive someone in business or commit fraud?  Have I shown disrespect or even contempt for other people’s property?  Have I done any acts of vandalism?  Am I greedy or envious of another’s goods?  Do I let financial and material concerns or the desire for comfort override my duty to God, to Church, to my family or my own spiritual well-being?
VIII.  Thou shalt not bear false witness against thy neighbor.
Have I told a lie in order to deceive someone?  Have I told the truth with the purpose and intention of ruining someone’s reputation (sin of detraction)?  Have I told a lie or spread rumors which may ruin someone’s reputation (sin of calumny or slander)?  Did I commit perjury by false swearing an oath on the Bible?  Am I a busybody or do I love to spread gossip and secrets about others?   Do I love to hear bad news about my enemies?

Sometimes it’s necessary to use a shorter list. The Our Sunday Visitor Web site has a good brief Catholic examination of conscience (opens in a new window).

I.  “I am the Lord, thy God, thou shalt not have strange gods before Me.”
III.  Remember to keep holy the Sabbath day.

Thermotron management Examination of Conscience lying cheating is A-Ok

A Detailed  Examination of Conscience

A goodexamination of conscience can be a great help in making a new start in the life of faith.
We use an examination of conscience to help call to mind our sins and failings during a period of quiet reflection before approaching the priest in Confession.
It’s important for a good Catholic examination of conscience to be thorough. This will help you learn about things that you may not be aware of. It’s also a chance to develop your conscience. This is a critical aid for the beginning.
To make an examination:

  • Set aside some quiet time for reflection.
  • Start by praying to the Holy Spirit, asking for help in making a good examination to prepare for Confession.
  • Read through the items on this list and honestly reflect on your behavior for each item.
  • If necessary, take this list or some brief notes (keep them private!) to Confession to help you remember things.

A Catholic examination of conscience traditionally follows the outline of the Ten Commandments and thePrecepts of the Catholic Church

Your attorney can advise you of your rights and let you know if you may be entitled to collect compensation in a lawsuit against your former employer.

thermotron management training “who is this??”

when i worked with john tenbrink– he was always trying to get his co workers to go to the BAR with him and get Drunk–

\when ever he could he would get the customer to come along– and buy him lunch– get him drunk–

and then ask the customer to writ a “glowing “report on his job performance–

and Bob Wiley the “lying idoit” Drunk– woule see what a “fine job” john tenbrink did for thermotron

yes john tenbrink was a find guy — who would lead his co workers astray– and then back stab them— just like thomas bannach — and his gang of liar’s and thieves

former employee

well you are right
it is safe to say “only say good things”

as i don’t have very many good things to say about the different liers thieves and embzzlers and drunks and slanders i worked with..at thermotron ..

nownow as tom bannish bragged it’s ok to be currupt ..
he like most of the people who are evil there will be dead and go to hell..

good riddence.

as a matter of face do you know of any of the people from there who have good character?

i can count them on one hand

But as i have never worked with such a big determined gang of liers, slanders and theves, as with thermotron..

The Boeing project i got introduced to tenbrink and durham.. both liers and embezzlers, and drunks this is the first time management allowed people to be drunk on the job and falseafy their work hours.. (i think not)

but bob wiles was a lier and a drunk..

I was the exception and that is why Mr Pietz at boeing hired me 3 years later.. i am normal.. and reliable. He said that he likes to hire people who u don’t have to wonder what they are doing

John TenBrink was such a bad example of a Thermotron employee that he could’nt get them to hire him even as a custodian, janitor. That was during the time boeing had over 25,000 thousand employees.. and he found that he couldn’t find a decient job any where in kansas..

So finally he begged Bob Wiley (he was now a promotion guy)at sexton Espec inc. because “Old Bob is as smart as a fox) ya right.. if u believe that then we will sell your children out as Whores.

But after misleading mardy rich.. and defrauding him, John Tenbrink got to go into sales.. and sales in the chamber business is getting the customer drunk and pretending u are their friend.

from there he went to Environtronics, where Gary Molinar was just leaving.. as he said about john.. it dosen’t take much to fill out a “request for material” and his evualiation of Environtronics was that as a “spin off” company.. they took 2 steps and fell on their face..

I met Gary Molinar at Russles Technicial Products.. and at this company Don Bench hired people who needed to learn a trade.. and learn a job

But Gary said he was different .. He came there to Do a Job” not just learn a job.

I quit here because Bill Bench was sending me out to start-up equipment that didn’t quite work right.. and finally bill told me that that it didn’t matter if the equipment worked at all, my job was to get the customer to sign off. I told him i didn’t defraud people. and lia.. so he drummed me out.. The last job in New York.. was typical of his style.. “he shipped a 40 by 50 foot walkin chamber that had never been tested or assembled..
and the customer thought there would be a factory team to complete this project.. but there was only me. ha

back at thermotron

Tom bannash promoted lieing cheating and stealing and embezzeling and slandering employees on the west coast, he said “everyone is the manager” and he would go around saying”sombody said , this or that but i didn’t believe it, or he would tell me and others that “He lied for U

Then he would send Dean Tripp an old time sales/manager/senior service guy to lie to his co-workers to find out what was going on. (dean tripp is in Farmington New Mex) he said they like people who are like this..

Tom Bannish bragged that Roger Cannery let him do “His thing which was:

1. it’s ok to lie, cheat and defraud people a little bit everyday (because everyone he knows is that way) he told me that everyone was cheating on their expenses and that i needed to do the same. (Get with the program)

2. if someone does a good job he will lie and say they did a bad job.

3.if someone does a bad job he will lie and say they did a good job

4.if some one needs help with a job, he will lie and say they don’t need help.

5.if someone doesnot need help he will lie and say that they need help.

the evil guy i worked with once showed me all the placed he robbed in Pasidena California as he was growing up.

He robbed customers daily and bo bjarno the sales staff and my self told tom banish and he considered it ok.

This guy robbed and embezzled over 50,000 dollars at thermotron

and jim roulfes helped him steal an additional 20,000 thousand

by removing bo bjarno the last blockage.

Now even though bo was a drunk he had better character than bannash.

Tom Bannash bragged he could lible slander every one and you people would believe his lies.,

Now the fact
that dan o’keff and tom bannash called employees and co-workers the “gay ” and the gay
blade behind” their back is another example of the slandering evil attitude that was there.

Hil sysbesma told me embezzling was not stealing it was “working the system”his rate was about $000 .00 while i was there…

So, now Jim Roulives made him a sales man..

the big joke was that he took a pay cut to go into sales.. ya right.

Oh ya Curtt (bo bjarno’s ) replacement said all jim rulloff did was walk around with a good grip on his ankles.

Obviously dan o’keef would make any Roman Catholic childmolester or petafile safe and proud,

Dan O’keefe did tell me that this company lets in any type of person.. when i asked Tom Bannash what the Hell he ment by that?

his reply was typical for a tom bannish

“I don’t know
Nobody else askes me that question.

ask wayne or mark lamers

oh what’s the surprise??

if u work for thermotron expect to be lied to .. because this company is run like a

male /female escort service

that will be EXTRA

thermotron if you don’t have a college degree, landing employment can be trickier. Here’s an idea.

July 2011

There are jobs all over the place for people with experience, good skills and a college degree.

If you don’t have all three of those, particularly if you don’t have a college degree, landing employment can be trickier. Here’s an idea.

Thermotron Industries in Holland is holding an open interview day on July 13, looking for as many as 20 people to work in its assembly areas.

No college degree required – although you have to have a high school diploma or a GED and it helps to have gone to community college because these jobs require the ability to think.

You don’t need a Education to work at Thermotron..Just a GED

thermotron oposite field service engineering – morals – management training

just tell them what ever they want to hear

when i was at thermotron
i asked them

the management team  thomas bannach, roger cannady, Dave waterfield and Daniel J O’keefe what they budgeted for the thieves—and embezzlers

because when you are working with the thieves at thermotron and the management team looks the other way– well then you just have to wonder–

BUT as Thomas Patterson said — well when you complained about working with the thermotron thieves– then they “the management team” attacked you  Ha ha

The thermotron thieves– call that being a backstabber– Dave Durham was another — who looks the part also, with john tenbrink– as so Dick alverson — said he know about the thieves

Thermotron management training — lying is OK—Not that there’s anything wrong with that

Thermotron management training — lying is OK—Not that there’s anything wrong with that

At thermotron

Bob Wiley set the standard for a management style straight out of Hell–

Bob wiley said it was ok to lie to him about what was going on — and slander and defraud you co workers a little bit– so long as you didn’t get him introuble..

John TenBrink– always did this to his co workers– he would miss lead them and defraud them — and tell that he would “talk” to Good –old– Bob–

Thomas Bannach went a bit farther down the road to Hell..

He said every one was the manager like him—

and That it is normal to lie, cheat, defraud, miss- lead, slander your co worker — and embezzle a little bit– because EVERY ONE HE KNOW IS LIKE THAT !!

SO, LYING CHEATING STEALING AND SLANDERING IS NORMAL,

And you were supposted to tell every on that he sure is a nice guy

Thermotron training Thieves hit dozens of Holland Township businesses

thermotron – and the neighborhood liars and thieves – “What if you’re wrong?” South Park

ok sure

Thermotron with gregrey V johnson the pet thief, embezzler and Thomas bannach false wittness..

jim roelofs – “What if you’re wrong?” bo bjarno

ok

jim roelofs fires    bo bjarno

Jim Roelofs is here but kicking back a little, we have tried to give him more responsibility several times and he says “No thanks”.
He’s reached that stage where he realizes responsibility has more drawbacks that positives and is real comfortable where he is – smart.
It amazes me how things repeat themselves and if you just pay attention to history you have a pretty good idea of what’s going to happen next.Hope things are well with you .Tom P.
interesting that jim r is with u.. because “Curt” who replaced bo bjarno.. said all he did at thermotron was walk around with a good grip on his ankles..
When we told chryel the 4th secretary that left the office, to mention to tom bannash .. that bo bjarno was drunk every day and it scared her..
all jim roelofs did was conspire to defraud him..
I had worked with him for 2 years drunk and asked dick Mc Kinley about it .. when he was hired..
But thomas bannach and bo bjarno — started the employee harrasment with Joyce palmer
and it continued with 3 or 4 more people over the next 2 years..
lying cheating stealing harassment and defrauding employees
this is the Thermotron model for management behavior–
and as Gregory V Johnson spent his time — stealing and robbing the customer and functioning as a false wittness for thomas bannach–
Contact Tamera Kennedy—  for your own opportunity to be a liar and a thief at THERMOTRON
as Bo bjarno style was get the customer or any one drunk .. and then find out how much money they had in the budget.. he was a flaming alcholic/..
and with greg johnson the pet thief, embezzler and banniah’s false wittness.. it was a pretty horrible place to work..

thermotron management – petty and vindictive –Sadly, if your boss is a liar , you can’t trust him.

ok start here

Bitching at the Office–Sadly, if your boss is a liar, you can’t trust him.

Thermotron– don’t you what 2 go into management??

ok

Is your boss   at THERMOTRON a liar?

(yes of course he is)

Does he give you false information about new accounts, fellow employees, job duties and office policies?

Are you constantly ciphering through his words in search of the truth? Well, don’t fret. You are not alone.

According to sites like “Bad Bossology,” a lot of people work for men and women who would rather lie than tell the truth. It’s an epidemic sweeping the nation.

The best example of a lying boss can be seen through the company Enron. The financial lies of the leadership in Enron caused hundreds of people to lose out on their life savings. It was a catastrophic event broadcasted all over the news.

So what should you do if you work for a lying boss?

Dealing with a lying boss is a challenge.

However, the challenge doesn’t lie with their behavior as much as it lies in how you respond to it. Most people fall into one of three categories. They act like a duck, a bird or an owl.

DUCKS
Employees who fall into this category refuse to the let the lies of their bosses get to them. So, they act like the lies don’t exist and let them roll off their back like water on a duck’s back. To outsiders, they appear perfectly content with their work conditions. Yet, secretly, they know what’s going on around them is oh-so wrong.

BIRDS
Employees who fall into this category hate to be lied to and resent their lying bosses. As a result, birds talk behind their bosses back constantly and even warn newcomers. This behavior usually adds kindle to an already unfriendly/tense work-relationship between themselves and their bad bosses. Birds truly want to quit their jobs, but their financial circumstances won’t let them. So, they do the next best thing, squawk about it.

OWLS

Employees who fall into this category accept the fact that their bosses are liars and act proactively in response to it. They take meticulous notes at meetings, save e-mails and keep up on office agenda. It’s the only way to really deter their bosses lies and let their bad bosses know that they can’t be taken advantage of. Owls usually are the go-to-people in the office, because of their job expertise and proactive behavior.

You’ve probably guessed by the descriptions that the balanced approach to a lying boss is to act like an owl

. Here’s a few other tips I’ve found on works sites all over the internet.Just:
GET IT IN WRITING.

Sadly, if your boss is a liar, you can’t trust him. So, for the important aspects of your job that can make or break you, get it in writing. You don’t have to tell him that you want it in writing because he is a liar. All you have to say is that you want to be clear on protocol. (Wink) If your boss refuses to do this, shoot him a quick e-mail re-capping your important discussions. Of course, he won’t like this, but it’ll provide you with a paper trail that you may have to use in the future.
ENLIST AN OFFICE “SOURCE.”
When you work for a lying boss, you will often get garbled information about office protocol, jobs and/or events. So maintain a relationship with an office go-to-person or source. This individual should be an old-timer who knows what’s going on at all times or at least can find out. Your source will be able to provide you with the truth behind your bosses lies.
STAY ON TOP OF COMPANY POLICIES.
Every office has a manual that you can refer back to in order to understand that goals and aspirations of the company. Stay abreast of this information because your lying boss may distort it for a variety reasons. What am I saying? You be an expert on the rules, so you won’t fall for a well-crafted fable.
Now that you’ve gotten a strategy for dealing with a lying boss, you will be able to wade relatively safely through their dishonesty. However, you do need to decide at one time or another if it’s worth all of the extra effort. If the pros start to dwindle, it may be time to find another job.

Passion Points – Caiaphas nullifies his own priesthood- thermotron with thomas bannach and Hil sybesma

ok

sure — what is TRUTH thomas w bannach— aand hil sybesma

the riligious understanding holland michig christian WHORES–

Hil Sybesma said he had the problem as thomas bannach–

he wanted to lie cheat deceive and defraud his co workers and the customer–

and he still wanted people to like him

Tuesday, July 16, 2013

The Truth Project– spent time with a thermotron liar and thief

yes

you can spend time with a thermotron liar and thief–

i was warned in 1971 that the holland michigan dutch and christian reformed were petty and vindictive

and Hil sybesma used those same “words” and phrase to describe the management style at thermotron,

Thomas patterson — said –“well if you don’t go long with what every they say ” then they “attack” you..

He thought it was funny as he said– Gee when john tenbrink and dave durham were embezzling and defrauding their hours and time and bein drunk on the job–

Bob
Wiley and his gang of thieves — attacked you– as the remedy– for that “UNWANTED information.

It is no doubt — that Boeing and other companies — would not hire john Tenbrink– because the only time he was working was when  Bob Wiley — was on the job  site–

other wise —  for get it– then John tenbrink would lie to him about the progress and his co workers
